Resources & Guides

Federal and state regulatory references for misfuel remediation operators, gas stations, insurers, and consumers. USIFDA is a private industry association, not a government agency; verify requirements with qualified counsel and your state and local authorities.

U.S. EPA — RCRA Hazardous Waste & Used Oil

Resource Conservation and Recovery Act (RCRA) — 40 CFR Parts 260–273

Contaminated or commingled fuel from misfuel events may be regulated as hazardous waste or used oil depending on characteristics, generator status, and how material is managed. Operators must comply with applicable generator requirements, manifests where required, and approved treatment or disposal.

Spills, SPCC, and Underground Storage Tanks

OSHA — Workplace Safety

Flammable liquids, hazard communication, and emergency response

U.S. DOT / PHMSA — Hazardous Materials Transportation

49 CFR Parts 171–180 (Class 3 flammable liquids)

Gasoline is commonly shipped as UN1203; diesel fuel as UN1202 or NA1993 (Class 3). Recovered fuel moved from a customer site or repair facility must comply with packaging, marking, shipping papers, placarding, and training rules as applicable.

NFPA, IFC, and Local Fire Codes

Storage, dispensing, and mobile operations

  • NFPA 30 — Flammable and Combustible Liquids Code
  • NFPA 30A — Motor Fuel Dispensing Facilities and Repair Garages
  • International Fire Code (IFC) Chapter 57 — adopted in many jurisdictions; check with your local fire marshal for permits, tank storage, and mobile fuel handling.
  • State environmental agencies (e.g., California DTSC, Texas TCEQ) — state waste rules may apply in addition to federal RCRA.

Fuel Quality & Consumer Protection

Federal fuel rules, ASTM specifications, and fair marketing

  • 40 CFR Part 1090 — fuel quality (including E15 pump labeling and misfueling mitigation)
  • ASTM D4814 — gasoline specification
  • ASTM D975 — diesel fuel specification
  • State weights and measures programs (NIST Handbook 130) — octane posting and dispenser accuracy
  • FTC Act Section 5 — unfair or deceptive acts or practices; state UDAP laws enforced by state Attorneys General
